RWE Generation NL is a subsidiary of RWE Generation SE. RWE Generation SE is the part of the RWE Group, stylized as RWE, that is responsible for power generation based on gas, hard coal, hydropower and biomass. [2] RWE Generation NL is headquartered in Geertruidenberg and has 6 locations in the Netherlands where it generates electricity with gas, biomass and coal powered plants. It employs over 600 people in the Netherlands [3]. RWE AG was founded in 1898 and entered the Dutch market in 2002 as RWE Energy Nederland (RWE NE) by taking over Obragas and Haarlemmergas. RWE became a big player in the Dutch energy market after taking over Essent B.V., of which is was the majority shareholder untill 2020.[4]

RWE Generation NL is a subsidiary of RWE Generation SE, which is again a subsidiary of RWE Group (or RWE AG). The CEO of RWE Generation SE is Roger Miesen. Romé van der Hoek is Chairman of the General Works Council of RWE Generation NL and a representative in the RWE Generation SE Supervisory Board.

Accountant

The financial reports and statements of RWE AG and its subsidiaries were in 2020 audited by PricewaterhouseCoopers GmbH Wirtschaftsprüfungsgesellschaft. The auditor of PricewaterhouseCoopers GmbH Wirtschaftsprüfungsgesellschaft who was responsible for the audits of RWE in 2020 was Ralph Welter.

Operations

RWE Generation NL has six plants where it generates electricity. Four of them run (partially) on gas and two on coal.[7] Their two coal plants currently run partially on biomass. At the plant in Geertruidenberg 80% of coal is replaced by biomass in terms of mass, at the plant in Eemshaven 15% of electricity is currently produced with biomass.[8]

Paris Agreement to Today

In 2015 RWE opened a large new coal plant in Eemshaven [9] However, in 2019 the Dutch government passed new legislation aimed at stopping the use of coal by 2030 as part of its commitment to the Paris Agreement [10]. Although the Dutch government calculated that the transtitional period would be sufficient for plant operators to recover their investments RWE claimed profits of their new plant would drop significantly, making their operation not profitable anymore.[11] In 2021 RWE sued the Dutch government for 1.4 billion euros claiming that the Dutch government had to compensate for the losses caused by the new legislation. [12] RWE makes its claim under the Energy Charter Treaty (ECT), a treaty that allows for companies to sue governments through an ISDS clause to sue governments if they believe their policies harm their investments. [13] In july 2021 Milieudefensie, Greenpeace, Urgenda, SOMO and other organizations called for the president of the tribunal to listen to their part of the story before making a decision.[14]

In 2021 the Dutch court ruled that the Dutch province Noord-Brabant has to reconsider the license it has given to RWE's Amer powerplant.[15] In a case filed by environmental organization Mobilization for Environment (MOB) it was claimed that the license had not sufficiently considered nitrogen emissions of the plant. By including a production unit in the calculations that was not operational anymore more room for nitrogen emissions was created than is actually allowed for. The province was given six months to adjust the license given to RWE, in the meantime the plant is allowed to run on normal capacity.

Current Policies and Emissions

RWE reports that in the Netherlands it emitted 7Mton of Co2 in 2020 compared to 9.1Mton in 2019.[16] This only covers scope 1 emissions. As for RWE group the scope 1 emissions are 70.4 Mton, scope 2 2.6 Mton and its scope 3 emissions 18.9 Mton in 2020.[17]

Climate Plans

RWE AG has set as a target to be carbon neutral by 2040. [18] It also aims to reduce their scope 1 and 2 emissions with 50% by 2030 and its scope 3 emissions with 30% compared to their 2019 baseline. [19]

A key strategy for RWE to reach their targets is phasing out coal from their operations. [20] Furthermore, RWE Generation NL will expand their capacity for generating renewable energy, increase the use of their storage technologies and use climate-neutral combustion fuels for energy generation. [21] In response to the Dutch governments decision to end coal powered electricity generation by 2030 to gradually convert their two coal-fired power plants in the Netherlands (Amer and Eemshaven) to biomass. [22] However, there is still debate on whether biomass is a sufficiently sustainable source of energy production.[23]

Under RWE Renewables Belenux B.V. RWE exploits 30 windmill parks in the Netherlands and plans to increase its capacity in windenergy the coming years.[24]

So far RWE has set no plans to phase out their gas powered electricity generation in the Netherlands.

Wij constateren dat uw ambitie is om CO2 neutraal te zijn in 2040.[27] Daarnaast constateren wij dat u ambieert uw scope 1 en 2 emissies in 2030 met 50% verlaagd te hebben en uw scope 3 emissies met 30% vergeleken met 2019.[28]

Hoewel wij constateren dat RWE in Duitsland onder de uitfaseringswet voor kolen (Kohleausstiegsgesetz) energiecentrales zal sluiten die op bruinkool draaien en in 2038 geen operationele bruinkool energiecentrales zal hebben [29] constateren wij tevens dat u in hoger beroep bent gegaan tegen de sluiting van de twee kolencentrales in Nederland.[30] Dit maakt uw ambities ongeloofwaardig.

Daarmee draagt uw bedrijf bij aan gevaarlijke klimaatverandering en loopt u het materiële risico om mensenrechtenschendingen te veroorzaken.
